What is Expungement?

In Rhode Island, the law requires that you need to be a first time offender to file a motion for expungement. If you are somebody who has two different probations in Rhode Island, it may be very difficult to get your cases, either of your cases, expunged. The bigger issue is to make sure that when your case is expungeable, that a motion is actually filed. The key part is that it is not automatic that your case is getting expunged just because it is eligible for expungement. It can happen that if you do not file a motion and you leave it, and you ever get a second case to include minor traffic offenses such as a suspended license charge, then you can literally be burdened with a couple of cases on your record forever. This could have been avoided it if you had gotten the first case expunged.
